- “Customer,” “you,” “your” refers to the person making a booking or participating in our tours
- “Services” refers to all tours, activities, transportation, and related services provided by the Company
- “Website” refers to the Twilight Sea Canoe website and any related platforms
- “Tour” refers to the Evening Glow Bioluminescent Night Paddle or any other tour package offered by the Company
- “Participant” refers to any person participating in a tour, whether or not they made the booking
3. Booking and Reservations
3.1 How to Book

3.2 Booking Confirmation
- All bookings are subject to availability
- Your booking is confirmed only when you receive a written confirmation email from us
- Confirmation includes tour date, time, pickup location, and booking reference number
- Please check all details carefully and notify us immediately of any errors
3.3 Minimum Age Requirements
- Participants must be at least 1 years old to join our tours
- Children aged 2 and under are complimentary (must sit on adult’s lap during boat transport)
- Children aged 4-12 years are charged the children’s rate of THB 1,925
- Children 12 years and older pay the regular adult rate
- Minors under 15 years old must be accompanied by a responsible adult
3.4 Group Bookings
- Group discounts available for 6 or more participants
- Private tour arrangements available upon request

3.5 Accuracy of Information
You are responsible for providing accurate information including:
- Full names of all participants
- Contact details (phone, email, hotel address)
- Dietary requirements and allergies
- Medical conditions that may affect participation
- Special requests or assistance needed
Failure to provide accurate information may result in service disruption without refund.
4. Pricing and Payment
4.1 Tour Prices
- All prices are listed in Thai Baht (THB) unless otherwise stated
- Prices include: hotel transfers, meals (lunch and dinner), equipment, guide services, and activities as specified
- Prices are subject to change without notice, but confirmed bookings will honor the quoted price
4.2 Payment Methods
We accept:
- Credit/Debit cards (Visa, MasterCard, American Express)
- Bank transfers
- Cash (for on-site bookings or as arranged)
- Online payment platforms as specified on our website
4.3 Payment Terms
- Full payment is required at the time of booking to confirm your reservation
- Payment must be received before the tour date
- For group bookings or special arrangements, alternative payment terms may be agreed upon in writing
4.4 Currency and Exchange Rates
- All transactions are processed in Thai Baht (THB)
- If paying in foreign currency, exchange rates are determined by the payment processor or bank
- Any currency conversion fees are the responsibility of the customer

5. Cancellation and Refund Policy
5.1 Cancellation by Customer
More than 24 hours before tour departure:
- 95% refund of the tour price
- Refund processed within 7-14 business days to original payment method
Less than 24 hours before tour departure (10 AM Thailand time UTC+7):
- No refund
- Booking is non-refundable and non-transferable
No-Show:
- No refund for failure to appear at pickup location
- No refund for missed tours without prior cancellation
5.2 How to Cancel
To cancel your booking:

- Cancellation is effective when you receive written confirmation from us
5.3 Refund Processing
- Refunds are processed to the original payment method
- Processing time: 7-14 business days from cancellation confirmation
- Bank processing times may vary; we are not responsible for delays by financial institutions
- Transaction fees charged by payment processors are non-refundable
5.4 Rescheduling
- Tour dates may be rescheduled subject to availability
- Rescheduling must be requested at least 24 hours before the original tour date
- One complimentary reschedule is permitted; additional changes may incur fees
- Rescheduling subject to price differences if applicable
5.5 Cancellation by the Company
Weather-Related Cancellations:
- If weather conditions make the tour unsafe, we reserve the right to cancel or modify the itinerary
- You will be offered:
- Full refund, or
- Reschedule to another date at no additional charge
- We are not liable for any indirect costs (travel, accommodation, etc.)
Operational Reasons:
- Tours may be cancelled due to insufficient bookings (minimum 4 participants required)
- Notification provided at least 24 hours in advance
- Full refund or alternative date offered
Force Majeure:
- Tours may be cancelled due to circumstances beyond our control (natural disasters, political unrest, pandemics, government restrictions, etc.)
- Full refund provided, but the Company is not liable for any consequential losses
6. Participant Requirements and Health
6.1 Health and Fitness
Participants must:
- Be in reasonable physical health to participate in kayaking activities
- Be able to sit in a kayak for 60-75 minutes at a time
- Be comfortable being on boats and near water
- Disclose any medical conditions that may affect participation
6.2 Medical Conditions
This tour is not suitable for:
- Pregnant women
- Individuals with severe back, neck, or joint problems
- Individuals with serious heart conditions
- Individuals with severe mobility limitations
- Anyone with medical conditions that could be aggravated by physical activity or time on water
6.3 Disclosure Requirement
You must inform us at the time of booking of any:
- Medical conditions, disabilities, or injuries
- Allergies (food or otherwise)
- Medications that may affect participation
- Special assistance requirements
Failure to disclose relevant medical information may result in:
- Denial of participation without refund
- Assumption of full liability for any resulting injury or incident
- Voiding of any insurance coverage
6.4 Swimming Ability
- Participants do not need to be strong swimmers (life jackets are mandatory)
- However, you must be comfortable being in and around water
- Inform guides if you are not comfortable swimming
6.5 Alcohol and Substances
- Participants under the influence of alcohol or drugs will not be permitted to join the tour
- No refund will be provided if you are denied participation for this reason
7. Safety and Conduct
7.1 Safety Guidelines
All participants must:
- Attend the mandatory safety briefing
- Wear life jackets at all times during water activities
- Follow all instructions from guides and crew
- Use equipment properly and responsibly
- Stay with the group and not wander off independently
7.2 Guide Authority
- Tour guides have full authority over safety decisions
- Guides may modify itineraries based on weather, safety, or group needs
- Participants must comply with guide instructions at all times
- Failure to comply may result in removal from the tour without refund
7.3 Participant Conduct
Participants are expected to:
- Treat guides, crew, and other participants with respect
- Not engage in behavior that endangers themselves or others
- Respect the natural environment and local communities
- Not damage equipment or property
- Not engage in illegal activities
Unacceptable behavior includes:
- Harassment, discrimination, or abusive language
- Reckless or dangerous behavior
- Deliberate damage to equipment or environment
- Disregarding safety instructions
- Public intoxication or substance use
Consequences:
- Participants engaging in unacceptable behavior may be removed from the tour immediately
- No refund will be provided
- You may be held liable for any damages or costs incurred
7.4 Environmental Responsibility
Participants must:
- Use only reef-safe sunscreen
- Not litter or pollute the marine environment
- Not touch, feed, or disturb wildlife
- Respect protected areas and cultural sites
- Follow “leave no trace” principles
8. Liability and Insurance
8.1 Assumption of Risk
By participating in our tours, you acknowledge that:
- Outdoor adventure activities involve inherent risks
- Kayaking, boating, and water activities carry risks of injury
- Weather and natural conditions can be unpredictable
- Wildlife encounters carry potential risks
- You voluntarily assume these risks
8.2 Limitation of Liability
To the maximum extent permitted by law:
- The Company is not liable for any indirect, incidental, or consequential damages
- The Company’s total liability is limited to the amount paid for your tour booking
- The Company is not liable for losses due to factors beyond our reasonable control
- The Company is not liable for personal belongings lost, stolen, or damaged during the tour
8.3 Personal Property
- You are responsible for your personal belongings at all times
- We recommend leaving valuables at your hotel
- Use waterproof bags for electronics and important items
- The Company is not responsible for lost, stolen, or water-damaged items
8.4 Insurance
- We strongly recommend purchasing comprehensive travel insurance
- Your insurance should cover:
- Medical expenses and emergency evacuation
- Trip cancellation and interruption
- Personal liability
- Loss or damage to personal belongings
- Adventure sports and water activities
- The Company does not provide personal insurance for participants
8.5 Medical Emergencies
- In case of medical emergency, we will provide reasonable assistance
- You are responsible for all medical costs incurred
- Your travel insurance should cover emergency medical treatment
- Emergency contact information must be provided at booking
8.6 Indemnification
You agree to indemnify and hold harmless Phuket Andaman Twilight Co., Ltd., its directors, employees, agents, and guides from any claims, damages, or expenses arising from:

9. Photography and Media
9.1 Photography During Tours
- Guides and crew may take photographs during tours for operational and promotional purposes
- By participating, you consent to being photographed
- Photos may be used in our marketing materials, website, social media, and promotional content
9.2 Opt-Out
- If you do not wish to be photographed or have your images used, please inform us in writing before the tour
- We will make reasonable efforts to exclude you from promotional photos
9.3 Participant Photography
- You are welcome to take photos during the tour for personal use
- Please be respectful when photographing other participants
- Do not use photos of other participants for commercial purposes without their consent
- Drones are not permitted in the national park areas we visit
9.4 Social Media
- We encourage sharing your experience on social media
- Please tag us @TwilightSeaCanoe
- Use our official hashtags as provided by your guide
10. Transportation and Pickup
10.1 Hotel Pickup Service
- Complimentary hotel pickup is included for hotels in central Phuket areas on main roads
- Pickup areas include: Patong, Kata, Karon, Phuket Town, and surrounding areas
- Private villas, hilltop locations, or remote accommodations may require meeting at a nearby designated location
10.2 Pickup Times
- Pickup times typically range from 10:45-11:15 AM depending on hotel location
- Exact pickup time will be confirmed via email after booking
- You must be ready in your hotel lobby 15 minutes before your scheduled pickup time
10.3 Late or Missed Pickup
- If you are not ready at the scheduled time, the vehicle may depart without you
- No refund is provided for missed tours due to late arrival

10.4 Incorrect Information
- Provide accurate hotel name and address at booking
- If your accommodation changes, notify us at least 24 hours in advance
- We are not responsible for missed pickups due to incorrect information provided by you
11. Itinerary and Services
11.1 Itinerary
- The tour itinerary is provided as a guide and may vary
- Actual activities, timing, and sequence may change due to:
- Weather conditions
- Safety considerations
- National park regulations
- Group size and dynamics
- Operational requirements
11.2 Bioluminescence
- Bioluminescent plankton is a natural phenomenon
- While we see it on all the time on our tours, we guarantee its appearance
- Factors affecting visibility: moon phase, water temperature, weather, plankton populations
- No refund is provided if bioluminescence is not visible
- The tour remains highly enjoyable with caves, lagoons, sunset, and night kayaking regardless
11.3 Wildlife Viewing
- Wildlife sightings are never guaranteed
- We visit areas with high wildlife activity, but animals are wild and unpredictable
- No refund for tours where specific wildlife is not seen
11.4 Inclusions
As stated in your booking confirmation:
- Hotel transfers (pickup and drop-off)
- Welcome drink
- Thai light lunch
- Thai dinner buffet
- Kayaking equipment and safety gear
- National park entrance fees
- Professional guides
- Travel insurance
- All specified activities

- Tips and gratuities
- Personal expenses
- Items not mentioned in the inclusion list
12. Food and Dietary Requirements

- Authentic Thai cuisine prepared fresh daily
- Lunch: Thai light meal served during cruise
- Dinner: Thai buffet with multiple dishes
- Water and beverages provided throughout the day
12.2 Dietary Requirements
- We accommodate vegetarian, vegan, and common dietary restrictions
- You must inform us of all dietary requirements, allergies, and food restrictions at the time of booking
- We cannot guarantee accommodation of restrictions not communicated in advance
- Severe allergies may limit menu options; please discuss with us before booking
12.3 Food Safety
- All food is prepared following hygiene and safety standards
- If you have concerns about Thai cuisine or food safety, please bring supplementary snacks
- We are not liable for adverse reactions to food unless caused by our negligence

Nothing in these Terms affects your statutory rights under Thai consumer protection laws.
